The legal framework and guidelines governing the engagement between Waajiri and Wajakazi on our platform.

Welcome to Mjakazi Connect. These Terms of Service ("Terms") govern your access to and use of the Mjakazi Connect platform ("the Platform"). By registering as a Mwaajiri (Employer) or Mjakazi (Domestic Worker), you agree to be bound by these Terms.

1. Definitions

  • Mwajiri (Plural: Waajiri): A household or individual seeking domestic services.
  • Mjakazi (Plural: Wajakazi): An individual offering domestic services.
  • Access Fee: The non-refundable payment made by a Mwajiri to unlock the Contact Vault.
  • Verification Fee: The payment made by a Mjakazi to facilitate third-party document screening.
  • Contact Vault: The secure portion of a profile containing direct contact information (Phone and Email).

2. Nature of Service

Mjakazi Connect is a High-Trust Digital Bureau. We provide a verified directory for discovery and matching.

Not an Employer: Mjakazi Connect is not an employer, agency, or payroll provider. Any engagement between a Mwajiri and a Mjakazi constitutes a direct private contract between those two parties.

Vetting Responsibility: While we facilitate document verification, Waajiri are solely responsible for conducting their own interviews, final background checks, and reference calls before hiring.

3. Registration & Verification

3.1 For Wajakazi

  • Accuracy: You must provide valid identification and a current Certificate of Good Conduct.
  • Verification Status: "Verified" badges are granted only after successful third-party screening. This status is valid for 12 months, after which re-verification is required.
  • Fees: The KSh 1,500 Verification Fee covers administrative costs and is non-refundable regardless of the verification outcome.

3.2 For Waajiri

  • Access: Access to the Contact Vault is granted upon payment of the chosen Tier Access Fee.
  • Usage: Contact information obtained must be used solely for the purpose of hiring domestic help for your household. Scraping, selling, or sharing this data with third parties is strictly prohibited.

4. Fees and Payments

  • No Auto-Renewals: All Access Fees are one-time payments for a fixed duration (2, 4, or 6 weeks). Access expires automatically unless manually renewed.
  • M-Pesa Integration: All payments are processed via M-Pesa. Access is granted immediately upon confirmation of payment.
  • No Refunds: As access to the Contact Vault and Document Vault constitutes immediate delivery of digital service, all fees are non-refundable.

5. Fair-Exchange & Replacement Policy

  • Levels 1 & 2: These are self-service discovery tiers. If a hire does not work out, the Mwajiri may utilize their remaining active subscription time to find a replacement. No managed replacements or duration extensions are provided.
  • Level 3 (Concierge): Includes a 30-day One-Time Replacement Guarantee. If a Mjakazi hired through the Concierge service leaves within 30 days of the start date, the Platform will conduct one additional matching cycle at no extra cost.

6. Intellectual Property

The Platform, including its code, design, logos, and the "Mjakazi Connect" name, is the exclusive property of Mjakazi Connect. You are granted a limited, non-exclusive license to use the platform for its intended purpose. You may not reverse-engineer, decompile, or attempt to extract the source code of the platform.

7. User-Generated Content

You are solely responsible for the content of your profile. While Mjakazi Connect screens documents for verification purposes, we do not guarantee the accuracy of self-written bios or descriptions. We reserve the right to remove any content that is offensive, illegal, or violates these Terms.

8. Data Protection (Kenya NDPA)

Mjakazi Connect is a Data Controller under the Kenya Data Protection Act.

  • PII: Personally Identifiable Information (ID cards, certificates) is encrypted at rest and only accessible to active subscribers.
  • Privacy: Users agree to the collection and processing of their data as outlined in our Privacy Policy.

9. Logistical Neutrality

Mjakazi Connect provides the discovery link only. We are not responsible for:

  • Transport or relocation costs for Wajakazi.
  • Provision of housing, food, or equipment.
  • Mediation of salary disputes or workplace grievances.

10. Indemnification

You agree to indemnify and hold harmless Mjakazi Connect and its officers from any claims, losses, or legal fees resulting from your violation of these Terms or your interactions with other users.

11. Termination of Access

We reserve the right to suspend or terminate any account that:

  • Provides fraudulent documentation.
  • Harasses other users or Platform staff.
  • Attempts to circumvent the Platform's payment or security systems.

12. Limitation of Liability

Mjakazi Connect shall not be liable for any direct, indirect, or incidental damages resulting from the conduct of Wajakazi or Waajiri, including but not limited to theft, injury, or breach of employment contract. Use of the platform is at your own risk.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be settled through amicable negotiation. If negotiation fails, the dispute shall be referred to arbitration in Nairobi, Kenya.

14. Amendments

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the new Terms.
